A 16yr old teenager with a single punch killed an 82yr old army veteran because he was told off by the army veteran for causing trouble at Derby bus station and gets just 2yrs in a youth detention centre.

Omar Moumeche, who was 16 at the time, violently attacked beloved Dennis Clarke at Derby bus station after he told off his friends for messing about on an escalator.

The army veteran suffered a skull fracture as well as a bleed on the brain from the assault and was rushed to Queen’s Medical Centre in Nottingham where he sadly died. Moumeche, now 18yrs old was found guilty of manslaughter back in July and sentenced to just two years at the Derby Crown Court.

Mr Clarke served with the Sherwood Foresters Regiment during his time with the army serving in Singapore. His nephew Ricky Darvey told the sentencing hearing his uncles death was devastating and will take his family many years to come to terms with.

‘There will forever be an empty chair at Christmas and an empty place on the dance floor.’ Darvey said.

Detective Inspector Mark Shaw said: ‘Our investigation was assisted by the capture of CCTV footage and many witness accounts, all of which were presented during the trial.

‘The vicious teenager claimed he acted in self-defence, and the jury on the balance and high threshold required refused to accept his version of events.

Andrew Baxter, from the CPS, said: ‘Dennis Clarke’s tragic death was the result of this young person’s intimidating and aggressive behaviour, refusing to back down and not knowing when to walk away.

‘Mr Clarke was within his rights to challenge the behaviour and had then gone about his business, assuming that the incident was concluded.

‘Moumeche chose to confront him at the bus station, behaving in an aggressive and intimidating way to a man in his 80s who posed no threat.

‘He then threw a punch which led to the death of an elderly and innocent man, and a family grieving a much-loved family member and respected member of the community.

‘I would like to offer everyone close to Dennis Clarke every sympathy for their loss.’

Judge Shaun Smith KC told Moumeche: ‘You could have walked away but you decided to get involved and shortly before you delivered the blow an 82-year-old man was surrounded by three youngsters and you struck him with a deliberate blow.’

No further action was taken against two other teenage boys who were arrested at the time in connection with the attack.
